Arizona’s Supreme Court ruled this week to let the lower Appellate Court’s ruling on medical marijuana stand.

The high court agreed that the federal Controlled Substances Act does not overrule Arizona’s voter approved medical marijuana law requiring counties to approve reasonable zoning regulations.

Steve White, an attorney for a medical marijuana dispensary said there’s a reason why the officials can’t go after medical sellers and users.

“You have a prohibition that doesn’t permit the Dept. of Justice from allocating any resources to the prosecution of people operating in legal marijuana states,” he said.

The federal law still makes marijuana illegal.

Maricopa County Attorney Bill Montgomery had sought to use the federal law to not only block new dispensaries, but effectively void Arizona voters’ decision to legalize the drug for medical use.
